The person in charge of the on-line file has access to all the information and transactional services contained in the business’s on-line file, whether current, modified or future.
He or she can also allow any person (hereinafter called the user) to access the file and, consequently, to consult the confidential information found therein.
To do that, the person in charge of the on-line file must give a user code and temporary password to all users, which will make it possible for them to access the on-line file.
The person in charge of the on-line file may grant each user consultation rights or the right to use the transactional services, depending on the on-line file’s different sections.
The person in charge of the on-line file holds all powers related to access management, including, in particular, the determination and assignment, suspension, reactivation or modification of the access rights of users.
La Financière agricole du Québec (FADQ) assigns a user code and temporary password to persons in charge of access management. The code and password are always sent by mail to the owner or associate of a business that registers for the on-line file or applies to designate a person in charge of access management.
When the owner or ONE of the associates of the business gives the responsibility of its file’s access management to another person, he or she must provide, on the form Application to designate a person in charge of access management, information that will allow the designated person in charge to authenticate him or herself the first time he or she accesses the on-line file.
After that, the user code and password assigned to the person in charge of access management will be activated.
Please note that the registration for the on-line file and the application to designate a person in charge of access management are documents that must be signed. Codes will only be activated once FADQ has received the application for registration on paper and judges that all the conditions have been met.
Persons in charge of access management can modify their user code and must change their temporary password when they use the on-line file for the first time.
They can then provide user codes and passwords to other users.
For security purposes, if the user code provided by FADQ is not used within three months after being sent, it will be destroyed.
After that period, if the person in charge of access management would like to access the on-line file, he or she must request a new code from FADQ. To do that, just click on Registration or contact a service centre.
As for users of the on-line file, they must ask for a new code from the person in charge of managing access to the on-line of the business concerned.
Persons in charge of access management are guarantors of any action taken with the user code and password assigned to them, unless the owner or ONE of the associates of the business informs FADQ of a change involving that person.
Holders of user codes are responsible for the confidentiality of their user code and their password, which are reserved for their exclusive use. They must therefore not allow anyone else to use them.
Persons in charge of access management are responsible for regularly modifying their password for security purposes.
Users are responsible for immediately informing the person in charge of access management of any unauthorized use of their user code and their password, or any attempt that could adversely affect access security. They must also take every possible measure to consult the on-line file and use the services under optimal security conditions.

Through the intermediary of the on-line file, once a year FADQ will transmit a note to every person in charge of access management informing them of the users that have access to their file, specifying the sections for which they are authorized.
In no case shall FADQ be held responsible for any loss or damage due to failure to comply with any of the obligations mentioned in this section “User code and password confidentiality”.
FADQ may modify the user terms and conditions of the on-line file at any time without notice, provided it issues new terms and conditions on its website. Persons in charge of access management must accept to regularly consult the FADQ website for that purpose, and the fact that they continue to use the on-line file signifies that they accept any modifications made by FADQ.
The closure of the session will be activated after a 30-minute period of inactivity.

The rights to access the on-line file are granted for an indefinite period.
FADQ may suspend or revoke any access to the on-line file without prior notice to users. It may therefore at any time, and effective immediately, refuse access to a file, notably if it has reason to believe that one of the conditions for use of the on-line file was not met or that a law may have been broken.
FADQ may suspend or revoke access (user code and password) that was not used for a year. To reactivate access:
FADQ may terminate access rights to the on-line file should an event occur that could modify registration conditions. That could include for example a business that went bankrupt, were dissolved or liquidated or the death of an individual (sole owner).
The owner or ONE of the associates of the business may ask FADQ to terminate their access rights to the on-line file at any time.
All data related to the on-line file is kept by FADQ in its databanks and constitutes proof, in the same way as data on paper constitutes proof.
The on-line file’s access history with a user code and password makes up part of the file’s data gathered over the Internet.
Every transaction carried out using a user code and password has the same legal force as if it were made in accordance with written instructions given by the applicant and signed by him or her.
The applicant is responsible at all times for the authenticity of the information provided using the on-line file and for the accuracy of the data entered. When completing the application for registration, the applicant agrees to notify FADQ of any changes related to the information provided.

FADQ assures the protection and confidentiality of information transmitted, by implementing security measures that comply with its legal obligations in this matter.

Any dispute that could stem from the application for registration or the on-line file’s conditions for use shall be governed by legislation enforceable in Québec. The business owner or associates recognize the exclusive authority and jurisdiction of Québec courts in this matter.
